Books Bundle is committed to protecting your privacy when you visit Books Bundle or use its services (“Services”) as further outlined in this policy. As a condition of using the Services of Books Bundle, you agree to provide Books Bundle with certain personal information. This information includes, but is not limited to: email address and your computer’s unique IP address (if any), financial information (email address used by your Stripe account) and demographic information (e.g., zip code, purchase history information as well as IP addresses that are not unique to your computer). Please note that nowhere on the Site do we knowingly collect contact information or financial information from children under the age of 13. Please review this privacy policy periodically as we may update it from time to time. This privacy policy was last revised on Jan 31, 2023. Each time you visit Books Bundle, use the Services, or provide us with information, you are accepting the practices described in this privacy policy at that time. You agree that by using the Site you are expressly and affirmatively consenting to our use and disclosure of the information that you provide, and consenting to receive emails, as described below in this privacy policy.
This policy may be revised over time as new features are added to the Site or as we incorporate suggestions from our users. If we are going to use or disclose your personally identifiable information in a manner materially different from that stated at the time we collected the information, you will have a choice as to whether or not we use or disclose your information in this new manner. We will also post a notification that the Privacy Policy has been amended prominently on our Web site so that you can always review what information we gather, how we might use that information, and under which conditions we will disclose it to anyone.
We use contact information i.e. your email address to help us efficiently perform account tasks (changing passwords, retrieving lost passwords), to deliver the services you have requested, to perform quality assurance, sales analyses and other business analyses, and to contact you in connection with any orders that you have placed with us. No other use of your financial information will be made except to satisfy any law, regulation, governmental request, or judicial order. When you make a purchase through the Site, or register with the Site, you will provide us with an email address where we, or these service providers, may contact you for the purposes described in this paragraph.
You agree, in consideration for the use of the Services provided by Books Bundle, to allow Books Bundle to use your personal information to send you marketing and promotional materials. Books Bundle may also send you marketing and promotional materials that promote third party products. Books Bundle will not rent or sell your personal information for use by third parties. These materials may include, but are not limited to: newsletters providing you with additional information on how to use the Services, and promotional offers for goods and services from Books Bundle or third parties.
Books Bundle may use your demographic information to perform business analyses or to tailor the Site and communications to your interests. We may share anonymous, aggregated demographic information with advertisers and other third parties so that they can tailor their advertisements and communications to the appropriate audience. Any time that we are allowed under this privacy policy to share your contact information or financial information, we may also share your demographic information along with it.
Books Bundle may disclose specific contact information when we determine that such disclosure is necessary to comply with law, to cooperate with or seek assistance from law enforcement or to protect the interests or safety of Books Bundle or other visitors to the site or users of the Services. Also, your contact information may be passed on to a third party in the event of a merger, acquisition, consolidation, divestiture, or a bankruptcy of Books Bundle.
Cookies : A “cookie” is a small file that we save on your computer’s hard drive that contains non-personal information. These cookies help to give you faster access to pages you have already visited. They also allow you to personalize your pages, and optimize your experience at our sites. We also use cookies to help us figure out how many people visit our sites, which of our web pages they visit, and how long they stay there. Sessions : “Session IDs” allow us to identify a particular user across multiple web page requests. This Session ID is maintained within your cookie file, where possible. If cookies are not enabled, or if the user’s internet browser program does not support cookies then Books Bundle will place the Session ID in the requested web page. This allows the end user to avoid having to continually re-enter certain information such as account name and password for every web page request. This Session ID expires whenever the user closes their internet browser.
Tracking : Many of our web pages also contain special electronic images (called a “single-pixel gif” or “gifs”) that allow us to gather only non-personally identifiable traffic statistics and other aggregate information about visitors to our sites. Books Bundle (through itself or third parties) uses this technology to collect and accumulate anonymous data that helps us understand and analyze the experience of people visiting our web sites and, along with other information you provide, customize your future visits and improve our web sites. For example, we capture data on the type of browser used, operating system software (e.g. Windows 95 vs. 98 or Macintosh), cookie preferences (whether the user has them turned on or off), and search engine keywords (what key words did a visitor use to get to our site). Please keep in mind that none of this information is personally identifiable and that we only distribute this information to internal staff at Books Bundle and to partners that have signed confidentiality agreements with us. Any information that we do share with partners reflects overall web site or Internet usage trends, not individual.
IP Address : Each time you visit the Site, we automatically collect your IP address and the web page from which you came. In order to administer and optimize the Site for you and to diagnose problems with our Site, we use your IP address to help identify you and to gather broad demographic information about you. We also use your IP address to restrict the access of your account to broader users.
Storage : You understand and agree that Books Bundle stores and processes your information on computers located in Morocco, and by providing any data to Books Bundle, you consent to the transfer of such information to the Morocco. When you a delete a file from your Books Bundle account, no link will remain between you and that file. Deleted files may stay cached in Books Bundle servers to save bandwidth in case other people request them.
CONTRIBUTIONS TO Books Bundle
By submitting ideas, suggestions, documents, and/or proposals (“Contributions”) to Books Bundle through its suggestion or feedback webpages or email addresses, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) Books Bundle is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Books Bundle shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) Books Bundle may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of Books Bundle without any obligation of Books Bundle to you; and (f) you are not entitled to any compensation or reimbursement of any kind from Books Bundle under any circumstances.
TERMINATION
You may terminate your Books Bundle account and access to the Books Bundle Services by submitting termination request to Books Bundle support. Account termination will be completed after you will get notice about successful termination from Books Bundle.
You agree that Books Bundle may, without prior notice, immediately terminate, limit your access to or suspend your Books Bundle account and access to the Books Bundle Services. Cause for such termination, limitation of access or suspension shall include, but not be limited to, (a) a breach or a violation of the TOS or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) discontinuance or material modification to the Books Bundle Services (or any part thereof), (d) unexpected technical or security issues or problems, (e) extended periods of inactivity, (f) engagement by you in fraudulent or illegal activities, and/or (g) non payment of any fees owed by you in connection with the Books Bundle Services. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in Books Bundle’s sole discretion and that Books Bundle shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Books Bundle Services.
Termination of your Books Bundle account includes any or all of the following: (a) removal of access to all or part of the offerings within the Books Bundle Services, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), (c) deletion of any Content or any part thereof posted by you, and (d) barring of further use of all or part of the Books Bundle Services.
III. INDEMNITY
You agree to indemnify and hold Books Bundle and its subsidiaries, affiliates, officers, agents, employees, partners, licensors and licensees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit, modify or otherwise make available through the Books Bundle Services, your use of the Books Bundle Services, your connection to the Books Bundle Services, your connection to the global network, your violation of the TOS, or your violation of any rights of another.
DISCLAIMER OF WARRANTIES and LIMITATION OF LIABILITY
By submitting ideas, suggestions, documents, and/or proposals (“Contributions”) to Books Bundle through its suggestion or feedback webpages or email addresses, you acknowledge and agree that: (a) your Contributions do not contain confidential or proprietary information; (b) Books Bundle is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) Books Bundle shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide; (d) Books Bundle may have something similar to the Contributions already under consideration or in development; (e) your Contributions automatically become the property of Books Bundle without any obligation of Books Bundle to you; and (f) you are not entitled to any compensation or reimbursement of any kind from Books Bundle under any circumstances.
You expressly understand and agree that:
(a) Your use of the Books Bundle services and software are at your sole risk. The Books Bundle services and software are provided on an “as is” and “as available” basis. Books Bundle and its subsidiaries, affiliates, officers, employees, agents, partners, licensors and licensees expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.
(b) Books Bundle and its subsidiaries, affiliates, officers, employees, agents, partners, licensors and licensees make no warranty that (i) the Books Bundle services or software will meet your requirements; (ii) the Books Bundle services or software will be uninterrupted, timely, secure or error-free; (iii) the results that may be obtained from the use of the Books Bundle services or software will be accurate or reliable; (iv) the quality of any products, services, information or other material purchased or obtained by you through the Books Bundle services or software will meet your expectations; (v) that you find the interface developed by the software to be user friendly and (v) any errors in the software will be corrected.
(c) any material downloaded or otherwise obtained through the use of the Books Bundle services or software is accessed at your own discretion and risk, and you will be solely responsible for and hereby waive any and all claims and causes of action with respect to any damage to your computer system, internet access, download or display device, or loss of data that results from the download of any such material.
(d) no advice or information, whether oral or written, obtained by you from Books Bundle or through or from the Books Bundle services or software shall create any warranty not expressly stated in the tos.
You expressly understand and agree that Books Bundle and its subsidiaries, affiliates, officers, employees, agents, partners, licensors and licensees shall not be liable to you for any punitive, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Books Bundle has been advised of the possibility of such damages), resulting from: (a) the use or the inability to use the Books Bundle services; (b) the cost of procurement of substitute goods and services; (c) unauthorized access to or alteration of your transmissions or data; (d) statements or conduct of any third party on the Books Bundle services; or (e) any other matter relating to the Books Bundle services.
Unless explicitly stated otherwise, any new features augmenting or enhancing the current Books Bundle Services, including the release of new Books Bundle properties, shall be subject to these TOS. You understand and agree that the Books Bundle Services are provided “AS-IS” and that Books Bundle assumes no responsibility for the timeliness, deletion, mis-delivery or failure to post or store any user communications or personalization settings. You further understand that Books Bundle Services may be interrupted and Books Bundle and the entities providing hosted servers shall not be liable for interruptions. You are responsible for obtaining access to the Books Bundle website and the Books Bundle Services, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with your subscription to the Books Bundle Services as hereinafter described. In addition, you must provide and are responsible for all equipment necessary to access the Books Bundle Services. You understand that the technical processing and transmission of the Books Bundle Services, including your postings or content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of sections 19 and 20 may not apply to you.
Refunds:
Due to the digital and instant nature of these products, we do not offer refunds or credits for any purchases made.
NO THIRD-PARTY BENEFICIARIES
You agree that, except as otherwise expressly provided in this TOS, there shall be no third-party beneficiaries to this agreement.
VII. NOTICE
Books Bundle may provide you with notices, including those regarding changes to the TOS, including by but not limited to email, regular mail, SMS, MMS, text message, postings on the Books Bundle Services, or other reasonable means now known or hereafter developed. Such notices may not be received if you violate this TOS by accessing the Books Bundle Services in an unauthorized manner. Your agreement to this TOS constitutes your agreement that you are deemed to have received any and all notices that would have been delivered had you accessed the Books Bundle Services in an authorized manner.
VIII. GENERAL INFORMATION
Entire Agreement. The TOS constitutes the entire agreement between you and Books Bundle and governs your use of the Books Bundle Services, superseding any prior version of this TOS between you and Books Bundle with respect to the Books Bundle Services. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other Books Bundle Services, affiliate services, third-party content or third-party software.
CHOICE OF LAW AND FORUM
You and Books Bundle each agree that the TOS and the relationship between the parties shall be governed by the laws of the jurisdiction of the Morocco, without regard to its conflict of law provisions and that any and all claims, causes of action or disputes (regardless of theory) arising out of or relating to the TOS, or the relationship between you and Books Bundle, shall be brought exclusively in the courts located in the Morocco. You and Books Bundle agree to submit to the personal jurisdiction of the courts mentioned above, and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.
Waiver and Severability of Terms. The failure of Books Bundle to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.
No Right of Survivorship and Non-Transferability. You agree that your Books Bundle account is non-transferable and any rights to your Books Bundle ID or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.
STATUTE OF LIMITATIONS
You agree that regardless of any statute or law to the contrary, any claim or cause of action by you arising out of or related to use of the Books Bundle Services or the TOS must be filed within one (1) month after such claim or cause of action arose or be forever barred.
Titles. The section titles in the TOS are for convenience only and have no legal or contractual effect.
